Client Alert: 8(a) participants notified by SBA to provide financials
On December 5th, the SBA notified all 4,300 8(a) participants they are mandated to provide financial documents for the last three fiscal years before January 5th, 2026 (Note this deadline has been extended to January 19, 2026) or they “may lose their eligibility to participate in the 8(a) Program and could face further investigative or remedial actions.” Please note this is part of an audit to expose fraud, waste, and abuse. We want to make sure our clients don’t miss this request and are able to respond in a timely manner. - Be alert to potential changes including the proposed S.3173, titled the Stop 8(a) Contracting Fraud Act which would prevent the SBA from awarding any new 8(a) sole source contracts until a full audit of the 8(a) Program is completed and a report is provided to Congress
